Privacy Policy

Finn ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains what information we collect when you use the Finn iOS application (the "App"), how we use it, and the choices and rights available to you. Please read this policy carefully before using the App.

By using Finn, you confirm that you are at least 18 years old and agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.

1. What Finn Is — and Is Not

Finn is a general wellness application. It is not a healthcare provider, health plan, or healthcare clearinghouse, and is not subject to the Health Insurance Portability and Accountability Act (HIPAA). Finn is not a medical device and has not been reviewed or cleared by the U.S. Food and Drug Administration. No information collected or generated by Finn constitutes medical advice, diagnosis, or treatment.

2. Information We Collect

Finn collects only the information you provide directly. We do not create user accounts, and we do not collect your name, email address, phone number, government ID, payment information, or any other information that directly identifies you.

Information stored locally on your device:

• A first name or nickname you provide during setup
• Your stated wellness goal and any risk factors you disclose
• Daily lifestyle check-in data: sleep hours, exercise frequency, diet quality, stress level, alcohol consumption, and similar entries
• Your calculated Sperm Score history and streak data
• Conversation history with the Finn AI coach
• Notification preferences

All of the above data is stored exclusively on your device using iOS local storage. It is never uploaded to our servers, never stored in the cloud, and never linked to any account or persistent identifier that we control.

Information transmitted when using AI coaching ("Talk to Finn"):

• When you send a message to Finn's AI coach, that message text — along with anonymized lifestyle context drawn from your local profile — is transmitted over an encrypted connection to our AI service provider (Anthropic, Inc.) via a proxy server hosted on Vercel, Inc.'s infrastructure.
• This transmission is used solely to generate a coaching response. Neither Finn nor our service providers store this conversation data beyond the time required to generate a reply. Anthropic's commercial API terms prohibit training on API data by default.
• We do not transmit your name, device identifier, or any information that would allow Anthropic or Vercel to identify you as an individual.

3. How We Use Your Information

We use the information described above solely to:

• Operate the App and provide you with your Sperm Score, daily log, streak, and progress tracking
• Generate personalized AI coaching responses via the "Talk to Finn" feature
• Deliver local push notifications (daily reminders, weekly summaries, and streak milestones) that you have opted into
• Improve the App's functionality based on non-identifiable, aggregated usage patterns observed locally on your device

We do not use your health or lifestyle data for advertising, marketing, behavioural profiling, or any data-mining purpose. We do not use your data to make automated decisions with legal or similarly significant effects on you.

4. Information We Do Not Collect or Share

• We do not create or maintain user accounts.
• We do not collect payment information of any kind.
• We do not upload your health or lifestyle data to any server.
• We do not use third-party analytics SDKs (such as Firebase Analytics, Mixpanel, or similar) within the App.
• We do not sell, rent, license, or share your personal information with advertisers, data brokers, or any third party for commercial purposes — ever.
• We do not store your AI coaching conversations on any server. Once a response is generated, the conversation text is not retained by us or our service providers.
• We do not store your health data in iCloud or any other cloud storage service.

5. Push Notifications

Finn uses Capacitor's local notification system to deliver reminders and milestone alerts. These notifications are generated and delivered entirely on your device — no notification content or delivery data is transmitted to any third-party push notification service. You may revoke notification permissions at any time through your device's Settings app.

6. Third-Party Service Providers

Finn uses the following third-party services in connection with the AI coaching feature only:

• Anthropic, Inc. — provides the Claude large language model API that generates coaching responses. Anonymized conversation text is transmitted to Anthropic solely to generate a reply. Anthropic's commercial API terms do not permit training on your inputs by default. Anthropic's privacy practices are governed by their own Privacy Policy.
• Vercel, Inc. — hosts our API proxy server through which AI requests are routed. Vercel processes request data transiently and does not store conversation content. Vercel's privacy practices are governed by their own Privacy Policy.

We have no other third-party service providers with access to your data.

7. Data Retention and Deletion

All locally stored data (your profile, check-in logs, Sperm Score history, and conversation history) is retained on your device until you choose to delete it. You may delete your data at any time from the Profile screen within the App. Uninstalling the App permanently removes all locally stored data from your device. AI coaching conversation text transmitted to our service providers is not retained after a response is generated.

8. Data Security

Your data is stored locally on your device and protected by iOS's built-in data protection and encryption features. Data transmitted to our AI service provider is sent over encrypted HTTPS connections. While we take reasonable steps to protect your information, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

Finn is intended exclusively for users who are 18 years of age or older. We do not knowingly collect any information from anyone under 18. If you believe a minor has used the App, please contact us at hello@finnfertility.com and we will take appropriate steps.

10. Your Privacy Rights

Because Finn stores all health and lifestyle data locally on your device — not on our servers — you have direct control over your data at all times. You may access, correct, or delete your data directly within the App or by uninstalling it.

California residents (CCPA/CPRA): Finn does not sell or share your personal information as defined by the California Consumer Privacy Act. You have the right to know what categories of personal information we collect, the right to delete your information, and the right to opt out of sale (which does not apply, as we do not sell data). Fertility and lifestyle data constitutes "sensitive personal information" under CCPA; we use it solely to provide the App's core features and for no other purpose. European Economic Area, UK, and Switzerland (GDPR): Fertility and reproductive health data is a "special category" of personal data under GDPR Article 9, entitled to the highest level of protection. Where GDPR applies to your use of the App, our legal basis for processing locally stored data is your explicit consent provided during onboarding. Our legal basis for transmitting anonymised conversation text to the AI API is also your explicit consent, obtained before you first use the "Talk to Finn" feature. You have the right to access, rectify, erase, and port your personal data; to withdraw consent at any time; to restrict or object to processing; and to lodge a complaint with your local data protection supervisory authority. Because your health data is stored locally on your device and not on our servers, the most direct way to exercise your right of erasure is to delete data within the App or uninstall it. For all other requests, contact us at hello@finnfertility.com. When conversation text is transmitted to Anthropic via our Vercel proxy, this constitutes a transfer of personal data to the United States. Such transfers are made pursuant to appropriate safeguards including standard contractual clauses where applicable.

Washington State (My Health MY Data Act): Finn recognises that fertility and reproductive health data is consumer health data under Washington's My Health MY Data Act. We collect this data only with your consent, use it only to provide the App's features, and do not sell or share it. You may withdraw consent and delete your data at any time as described above.

Other US state residents: Residents of Virginia, Colorado, Connecticut, Texas, and other states with comprehensive privacy laws may have additional rights regarding their personal data. To exercise any such rights, please contact us at hello@finnfertility.com.

11. Breach Notification

In the event of an unauthorised disclosure of your health information that constitutes a breach under applicable law, including the FTC Health Breach Notification Rule, we will notify affected users promptly and in accordance with applicable legal requirements, which may include notification within 60 days of discovery. Because your health data is stored locally on your device, the most likely scenario for a breach would be unauthorised access to your physical device, which is outside our control.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you via an in-app alert. The "Last updated" date at the top of this page reflects the date of the most recent revision. Continued use of the App after changes become effective constitutes your acceptance of the revised policy.

Please read these Terms of Service ("Terms") carefully before downloading or using the Finn iOS application (the "App"). These Terms constitute a legally binding agreement between you and Finn ("we," "us," or "our"). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download or use the App.

1. IMPORTANT MEDICAL DISCLAIMER — READ FIRST

FINN IS A GENERAL WELLNESS APPLICATION. IT IS NOT A MEDICAL DEVICE, MEDICAL SERVICE, OR HEALTHCARE PROVIDER. FINN DOES NOT DIAGNOSE, TREAT, CURE, PREVENT, MONITOR, OR PREDICT ANY MEDICAL CONDITION, DISEASE, OR HEALTH OUTCOME, INCLUDING ANY FERTILITY-RELATED CONDITION OR INFERTILITY.

THE SPERM SCORE IS A LIFESTYLE WELLNESS INDICATOR CALCULATED SOLELY FROM THE LIFESTYLE INFORMATION YOU PROVIDE. IT IS NOT A CLINICAL ASSESSMENT OF SPERM QUALITY, COUNT, MOTILITY, MORPHOLOGY, OR ANY OTHER MEDICALLY MEASURABLE PARAMETER. 2. About Finn

Finn is a general wellness and lifestyle coaching application designed to help adult men understand the potential relationship between everyday lifestyle habits — including sleep, exercise, diet, stress management, and alcohol consumption — and general reproductive wellness. Finn provides a lifestyle-based Sperm Score, daily habit tracking, progress monitoring, and AI-powered general wellness coaching.

Finn is not a covered entity or business associate under HIPAA. Finn is not an FDA-regulated medical device. Finn has not been reviewed, approved, cleared, or authorised by the U.S. Food and Drug Administration or any other regulatory body for any medical purpose.

3. Eligibility

You must be at least 18 years of age to download or use Finn. By using the App, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into a binding agreement. If we discover that a user is under 18, we will take appropriate steps to disable that user's access to the App. Finn is not intended for use by minors under any circumstances.

4. Your Use of the App

Finn grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on your iOS device solely for your personal, non-commercial wellness purposes, subject to these Terms.

You agree that you will not:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse-engineer, decompile, disassemble, or extract the source code or underlying algorithms of the App
• Attempt to probe, scan, or test the vulnerability of the App or any associated server or network
• Use the AI coaching feature to deliberately generate dangerous, harmful, or medically inaccurate content
• Present or distribute any AI-generated coaching response as professional medical advice to yourself or any other person
• Use the App to develop a competing product or service
• Remove or obscure any proprietary notice, trademark, or copyright notice within the App
• Use the App on behalf of, or for the benefit of, any third party without our written consent

You use the App at your own risk and are solely responsible for all decisions and actions you take in connection with your use of the App, including any lifestyle changes made in reliance on the App's Sperm Score, content, or AI coaching responses.

5. The Sperm Score

The Sperm Score is a proprietary lifestyle wellness metric calculated by Finn's algorithm based solely on the lifestyle data you enter into the App. The Sperm Score is intended to encourage healthy habits and provide a motivational reference point. It is expressly not a clinical test result, medical diagnosis, or prediction of fertility outcomes. The methodology underlying the Sperm Score has not been peer-reviewed or validated in clinical trials. Any perceived improvement or decline in your Sperm Score does not necessarily correspond to a change in your actual reproductive health. You should not make any medical or reproductive decision based on your Sperm Score without first consulting a qualified healthcare professional.

6. AI Coaching — "Talk to Finn"

The "Talk to Finn" feature uses an artificial intelligence large language model provided by Anthropic, Inc. to generate general wellness coaching responses. You acknowledge and agree that:

• Coaching responses are generated by an AI system and are not provided by human medical professionals, coaches, or Finn employees
• AI-generated content may be inaccurate, incomplete, outdated, or inapplicable to your specific situation — a phenomenon sometimes called "hallucination"
• You assume all risk associated with reading, evaluating, and acting on any AI-generated coaching response
• You will independently verify any health, medical, nutritional, or lifestyle information received through AI coaching before relying on it
• Finn does not store your AI coaching conversations on any server; conversation text is transmitted to generate a response and is not retained thereafter
• The AI coaching feature is provided for informational and motivational purposes only and is not a substitute for professional medical advice under any circumstances

7. Assumption of Risk

You voluntarily assume all risks associated with your use of the App, including but not limited to: the risk that lifestyle changes made in reliance on the App's Sperm Score or AI coaching content may not produce desired health or reproductive outcomes; the risk that AI-generated coaching responses may contain errors; and the risk that your use of the App may not improve, and could be unrelated to, your actual reproductive health. You acknowledge that individual health outcomes depend on many factors beyond the lifestyle variables tracked by the App, and that no wellness application can replace individualised medical evaluation and care.

8. Intellectual Property

The App and all of its contents — including but not limited to the software, source code, algorithms, Sperm Score methodology, AI prompt configurations, design elements, graphics, text, trademarks, service marks, trade dress, and the Finn character and name — are owned by us or our licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of the text you submit through the AI coaching interface. By submitting text, you grant us a limited, non-exclusive licence to transmit that text to our AI service provider for the sole purpose of generating a coaching response. We make no other claim to your conversation inputs.

Nothing in these Terms grants you any right, title, or interest in or to the App or its intellectual property beyond the limited use licence described in Section 4.

9. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully, as it describes what information we collect, how we use it, and your rights. By using the App, you consent to the data practices described in our Privacy Policy.

10. Third-Party Services

The App uses Anthropic's Claude API (via a Vercel proxy) to power the AI coaching feature. Your use of these underlying services is subject to Anthropic's and Vercel's respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION: (A) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT; (B) ANY WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, OPERATE WITHOUT INTERRUPTION, BE ERROR-FREE, OR BE SECURE; (C) ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR CURRENCY OF ANY CONTENT, SPERM SCORE, OR AI COACHING RESPONSE PROVIDED THROUGH THE APP; AND (D) ANY WARRANTY THAT THE APP IS FREE OF VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS; IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE TO YOU FOR ANY: (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND; (B) LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS; (C) PERSONAL INJURY, BODILY HARM, OR WRONGFUL DEATH; (D) DAMAGES ARISING FROM YOUR RELIANCE ON ANY AI-GENERATED COACHING RESPONSE, SPERM SCORE, OR WELLNESS INFORMATION PROVIDED THROUGH THE APP; (E) DAMAGES ARISING FROM YOUR FAILURE TO SEEK PROFESSIONAL MEDICAL ADVICE; OR (F) DAMAGES ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DEVICE OR DATA — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY ON WHICH ANY CLAIM IS BASED.

TO THE EXTENT DAMAGES ARE NOT EXCLUDED BY THE FOREGOING, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE APP — WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE — SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY US DOLLARS (US$50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES (INCLUDING PERSONAL INJURY DAMAGES). IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the App; (b) your violation of these Terms or any applicable law or regulation; (c) your reliance on any AI-generated coaching response, Sperm Score, or wellness content for any health, medical, or lifestyle decision; (d) any claim by a third party arising from your use of the App; or (e) your provision of inaccurate information to the App.

14. Dispute Resolution and Governing Law

Informal resolution. Before initiating any formal dispute, you agree to contact us at hello@finnfertility.com and provide a written description of your dispute and the relief you seek. We will attempt to resolve the dispute informally within 30 days of receipt. If we are unable to resolve the dispute informally, either party may proceed as set out below.

Binding arbitration. EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, YOU AND WE AGREE TO RESOLVE ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THESE TERMS OR THE APP — REGARDLESS OF WHEN IT AROSE — EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.

Class action waiver. YOU AND WE EACH AGREE THAT ANY PROCEEDING — WHETHER IN ARBITRATION OR IN COURT — SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable in connection with any particular claim, then the entire arbitration provision shall be inapplicable to that claim only, and that claim shall be resolved in court.

Opt-out. You may opt out of the arbitration agreement by sending written notice to hello@finnfertility.com within 30 days of first accepting these Terms. Your opt-out notice must include your name and a clear statement that you wish to opt out of arbitration.

Small claims. Either party may bring an individual action in a small claims court of competent jurisdiction for disputes within that court's jurisdictional limits, without first engaging in informal dispute resolution.

Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in California.

15. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any feature of it at any time, with or without notice, and without liability to you. We may update these Terms from time to time. We will notify you of material changes via an in-app alert. The "Last updated" date at the top of these Terms reflects the date of the most recent revision. Continued use of the App after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the App.

16. Termination

We may suspend or terminate your access to the App at any time for any reason, including breach of these Terms, without notice and without liability. Upon termination, the licence granted to you under Section 4 will immediately cease. All provisions of these Terms that by their nature should survive termination — including Sections 1, 7, 8, 11, 12, 13, and 14 — shall survive.

17. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. You may not assign these Terms or any of your rights under them without our prior written consent. We may assign these Terms freely.
